By accessing or using nonconformistinc.com (the "Site") or engaging Non-Conformist Inc for any service, you agree to these Terms & Conditions ("Terms").

If you're using the Site or engaging us on behalf of a company, you represent that you have authority to accept these Terms for that company. If you don't agree with these Terms, please don't use the Site or our services.

Non-Conformist Inc ("Non-Conformist Inc," "we," "us," or "our") is a business systems company that builds focused systems for companies — including CRM, lead capture, automation, AI-supported workflows, websites, funnels, dashboards, reporting, sales assets, and operations workflows.

The Site presents information about our services and provides ways to apply for a build, request a paid Business Systems Assessment, or get in touch. It is informational and does not constitute an offer that's binding until a specific engagement is agreed in writing.

You may use the Site for lawful purposes and in line with these Terms. You agree not to:

• Use the Site in any way that breaks applicable laws or regulations.
• Attempt to gain unauthorized access to the Site, its servers, or connected systems.
• Interfere with or disrupt the Site, introduce malicious code, or place an unreasonable load on our infrastructure.
• Copy, scrape, or harvest content or data from the Site except as expressly permitted.
• Submit false, misleading, or fraudulent information through our forms.
• Use the Site to infringe the rights of others or to transmit unlawful, harmful, or objectionable material.

We may suspend or restrict access to the Site at any time if we reasonably believe these Terms are being violated.

The Site describes the types of systems we build, but the specific scope, deliverables, timeline, and price of any work are defined in a separate written agreement, proposal, or statement of work for that engagement.

Where these Terms and a signed engagement agreement differ, the signed engagement agreement governs that engagement. Information on the Site — including examples of past work, service descriptions, and process explanations — is provided to help you understand what we do, not as a guarantee of any particular result.

When you submit an application through Choose Your System or request a Business Systems Assessment, you're asking us to review your information and determine fit. Submitting a request does not create an obligation for us to take on the work, or for you to proceed.

The Business Systems Assessment is a paid engagement, with pricing and scope confirmed with you before it begins. It is a diagnostic service, not a free consultation, and its deliverables are described at the point of engagement. Any credit of assessment fees toward a future build applies only as stated in writing at that time.

You agree that the information you submit is accurate and that you're authorized to share it.

Fees for assessments and builds are set out in the applicable proposal, statement of work, or invoice. Unless stated otherwise:

• Prices shown on the Site (such as "assessments start at $2,500") are starting points and indicative ranges, not final quotes. Final scope and price are confirmed in writing before work begins.
• Invoices are due according to the terms stated on the invoice or in the engagement agreement.
• Fees are exclusive of any applicable taxes unless stated otherwise.
• Third-party costs — such as software subscriptions, platform fees, or licenses — are your responsibility unless your agreement says we cover them.

Late or non-payment may result in suspension of work. Specific refund, deposit, and cancellation terms are governed by your engagement agreement.

Our content

The Site and its content — including text, design, graphics, logos, and the "Don't Rebel. Reimagine." brand — are owned by Non-Conformist Inc or used with permission, and are protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from Site content without our written permission.

Work product

Ownership of deliverables created during an engagement — systems, configurations, assets, and documentation — is governed by your engagement agreement. Unless that agreement says otherwise, we may retain ownership of our underlying methods, templates, frameworks, and pre-existing tools, and may reuse general knowledge and experience gained during the work.

For engagements to succeed, we rely on you to:

• Provide accurate information, access, and materials we reasonably need to do the work.
• Respond to requests for feedback, approvals, and decisions in a timely way.
• Hold the necessary rights to any content, data, or accounts you ask us to work with.
• Maintain your own backups and comply with the terms of any third-party platforms involved.

Delays or gaps in client cooperation may affect timelines, scope, and cost.

Our work often involves third-party platforms — such as HubSpot, GoHighLevel, email and CRM tools, scheduling tools, and other software. Your use of those platforms is subject to their own terms and pricing, and we don't control and aren't responsible for their availability, performance, or policies.

The Site may also link to third-party websites. Those links are provided for convenience and don't imply endorsement. We're not responsible for the content or practices of sites we don't operate.

We don't warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that information on it is complete or current at all times. Nothing on the Site is legal, financial, or professional advice. This section does not limit warranties that are expressly made within a signed engagement agreement.

To the fullest extent permitted by law, Non-Conformist Inc and its founders, team, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunities, arising out of or related to your use of the Site.

For any engagement, our total liability is governed by the applicable engagement agreement. Where no such limit is stated, our total aggregate liability arising from the Site or a given engagement will not exceed the amount you paid to us for the service giving rise to the claim.

You agree to indemnify and hold harmless Non-Conformist Inc and its founders, team, and partners from any claims, damages, losses, and reasonable expenses (including legal fees) arising from your use of the Site, your violation of these Terms, or your infringement of the rights of any third party in connection with your use of the Site or our services.

We may update these Terms from time to time to reflect changes in our practices or legal requirements. When we do, we'll revise the "Last updated" date at the top of this page. Your continued use of the Site after an update means you accept the revised Terms.
